1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of www.arizonaboostersfoundation.org and any services, programs, campaigns, or content offered by Arizona Boosters Foundation (“ABF,” “we,” “us,” or “our”). By using the Site or participating in any ABF program, you agree to these Terms. If you do not agree, do not use the Site.

2. About ABF

Arizona Boosters Foundation is a 501(c)(3) nonprofit organization (EIN: 39-3080525) headquartered in Arizona, providing nationwide support to athletes, teams, coaches, business partners, and communities through fundraising, NIL opportunities, scholarships, uniforms and gear access, nutrition resources, and partnership programs.

3. Eligibility

You must be at least 18 years old, or have the involvement and consent of a parent or legal guardian, to submit forms, donate, or participate in ABF programs. By using the Site, you represent that you meet these requirements.

4. Donations

All donations made to ABF are voluntary and, to the extent permitted by law, tax-deductible. Donors will receive a written acknowledgment for tax purposes. Donations are generally non-refundable; however, refund requests due to error or duplicate transactions may be considered on a case-by-case basis. Contact contact@arizonaboostersfoundation.org within 30 days of the transaction.

ABF retains discretion in allocating donated funds consistent with our mission. Donations designated for a specific campaign or team will be applied to that purpose unless the designated purpose becomes impractical, in which case ABF will redirect funds to a similar program.

5. Fundraising Campaigns

Teams, athletes, and organizers may apply to run campaigns under ABF’s 501(c)(3) umbrella. By submitting a campaign request, you agree:

  • To provide accurate and truthful information about your team, sport, and purpose
  • That ABF has final approval authority over which campaigns are accepted
  • That ABF may set fees, hold periods, disbursement schedules, and reporting requirements
  • That ABF retains oversight to ensure compliance with nonprofit and tax law
  • That funds raised must be used for the charitable purpose described in the campaign
  • That ABF may terminate or pause a campaign for misrepresentation, misuse of funds, or violation of these Terms

6. NIL Opportunities

ABF facilitates introductions between student-athletes and brand partners for NIL (Name, Image, and Likeness) opportunities. By participating, you acknowledge:

  • ABF is not a party to any NIL contract between you and a third-party brand
  • You are responsible for compliance with applicable NCAA, state, school, and association NIL rules
  • You are responsible for your own tax reporting and obligations
  • ABF does not guarantee deals, earnings, or specific outcomes
  • For athletes under 18, a parent or legal guardian must consent to and may need to sign agreements
  • You are responsible for the content you create and post in connection with any NIL deal

7. Scholarships and Applications

Scholarship and program applications are evaluated based on criteria ABF establishes. Submitting an application does not guarantee an award. ABF reserves the right to modify, suspend, or discontinue scholarship programs at any time.

8. Partner and Business Relationships

ABF features and works with business partners, sponsors, and vendors. Listing of a partner on the Site does not constitute endorsement of every product or service, nor does it create a joint venture, agency, or employment relationship. Transactions you enter into with partners are between you and the partner, and ABF is not responsible for those transactions.

9. Acceptable Use

When using the Site, you agree NOT to:

  • Submit false, misleading, or fraudulent information
  • Use the Site for any unlawful purpose
  • Impersonate any person, team, or organization
  • Upload or transmit viruses, malicious code, or harmful content
  • Attempt to gain unauthorized access to any part of the Site or our systems
  • Harvest or scrape data from the Site without written permission
  • Interfere with the operation of the Site or other users’ use of it
  • Use ABF’s name, logo, or trademarks without prior written consent

10. User Submissions

If you submit content to ABF (campaign descriptions, photos, testimonials, applications, messages), you represent that you have the right to share it and grant ABF a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating, promoting, and reporting on our programs. You can request removal of your submitted content by contacting us, subject to recordkeeping obligations.

11. Intellectual Property

The Site, including text, graphics, logos, images, and software, is owned by or licensed to ABF and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial viewing.

12. Third-Party Links and Partners

The Site contains links to third-party websites (including partners such as Sly Energy and others). ABF does not control and is not responsible for the content, policies, or practices of third-party sites. Access them at your own risk.

13. Disclaimers

THE SITE AND ALL CONTENT, PROGRAMS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. ABF DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Information on nutrition, NIL, scholarships, and fundraising is provided for general informational purposes and is not legal, tax, medical, or financial advice. Consult a qualified professional before making decisions.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARIZONA BOOSTERS FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, PARTICIPATION IN PROGRAMS, OR INTERACTIONS WITH PARTNERS. ABF’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU CONTRIBUTED OR RECEIVED THROUGH ABF IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify and hold harmless ABF and its directors, officers, employees, volunteers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, your participation in ABF programs, or your violation of these Terms.

16. Modifications

We may revise these Terms at any time by posting an updated version on this page. Continued use of the Site after changes constitutes acceptance. Material changes will be noted at the top of this page.

17. Termination

ABF may suspend or terminate your access to the Site, a campaign, or any program at any time, with or without notice, for violation of these Terms or for any other reason at our discretion.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction and venue.

19. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full effect.
